Immigration have started a process to change their policy on various work visas including Essential Skills and Work to Residence visas. A number of work visa are no longer available and have been replaced by the Accredited Employer Work Visa

Introducing a new employer-led visa application process that will involve 3 stages — EMPLOYER ACCREDITATION, JOB CHECK AND ACCREDITED EMPLOYER WORK VISA
- a new temporary work visa that replaces 6 temporary work visas

Some visas and employer schemes have been replaced
From July 2022, a new temporary work visa will replace 6 existing visas:
- Essential Skills Work Visa
- Essential Skills Work Visa — approved in principle
- Talent (Accredited Employer) Work Visa
- Long Term Skill Shortage List Work Visa
- Silver Fern Job Search Visa, and
- Silver Fern Practical Experience Visa.
EMPLOYER ACCREDITATION EMPLOYERS MUST APPLY FOR ACCREDITATION IF THEY WISH TO EMPLOY MIGRANTS Employer need to show:
- you have not made a loss over the last 2 years
- you have had a positive cash flow each month for the last 6 months
- you have enough capital or external investment for your business to remain viable, or
- you have a credible 2-year plan to ensure your business remains viable.
Your must also be compliant with New Zealand immigration law, employment and business standards.
JOB CHECK – Employer must provide a job offer and employment agreement and have advertised the role (with pay rate) unless it is a role on the Green list and the pay must be at least $27.76 unless the job is on the exempt list. Some roles in construction and infrastructure, and tourism and hospitality must pay at least NZD $25 an hour. Specific jobs in the care workforce sector must be paid at least NZD $25.39 an hour
WORK VISA -once the employer has completed the Job check process they can invite the migrant to apply. The migrant will need to evidence good health and character that they are bona fide and is suitably qualified for the role

Hi Miki, You can still apply but the employer will need to evidence that they have advertised and been unable to find suitable New Zealand workers to do the role.

I work as a contract administrator (511111) in Wellington. I applied as a walk-in since the position was not advertised but i came to know about the vacancy through word of mouth. I got the job and i meet all criteria for Permanant Residency under SMC. I have already been with the organisation for 10 months now. Will i be able to apply for residency because the position was not advertised? Does my occupation fall in the Essential Skills Demand List for which advertising isnt necessary? Please advise

Hi Anna, provided your employment is consistent with the conditions on your current visa the fact it was not advertised should not be a problem. It is not on any of the skill shortage list. Hi Rodger – Telecommunications Technician is yes, but you have to meet the requirements of that list. Which includes NZQF level 4 qualification or above which includes the credit & knowledge required of one of the strands of the NZ certificate in telecommunications level 4.
